Problem is that we do not have the PXO server or client code. The client side code was explicitly removed before the source code was released to us, and we never had the server-side code (and it's likely lost now).

Secondly, these new regulations do not apply to us. FreeSpace does not require online authentication and is perfectly playable without the PXO matchmaking service, and to top it all off, we've developed our own replacement for PXO a long time ago.

Well the big question is whether we'd even want PXO back at all. It's not like FS2netD doesn't do pretty much everything it did (apart from squad war which is being worked on already).

Also as the code was released with terms allowing for code to be modified or created even if there was an issue with online authentication there is nothing in the terms to stop us bypassing the authentication anyway so this ruling is a mute point in terms of FreeSpace.

I could see this causing a lot of issues when things like MMO's shut down

It's a "moot point". :) Well, for FS it doesn't matter, but for MMOs it might now be possible to keep the game working after it's officially shut down. It also encompasses the case of Steam or its copycats shutting down, as people would be able to legally patch out the dependency.
