Fixxored.  Sorry, but my pulse had just jumped by about 30.

EDIT: Basically, they banned:
1) Windows version of BtRL
2) Windows patch for users who got the corrupt version
3) Linux version
4) Mac version
5) Soundtrack
(basically, they banned BtRL)
6) Me

I don't use VUZE anyway, so no biggie for me if I get banned.

Just send a reply to them and explain that this is a completely freeware game based on a fully open-source engine.  At the very least, the ball will be back in their court.

I'd imagine it's the BSG content, not the FS2 content, that got him banned.

Well that's fascinating, in a bad sense of the word...

What matters is obviously whether they received a DMCA takedown notice or something, or did they simply do it on their own initiative after getting effectively DDOSed by download requests... :nervous:

If the former, well, let's just keep our fingers crossed that it's not the sign of things to come. If the latter... well, it sucks but there are other hosting services as well, and it is within Azureus' rights to do crap like this, if you read the small text in Azureus Terms of Service (http://www.vuze.com/Terms.html#TermsOfService):

Quote
11. Termination; Terms of Service Violations.

11.1 Azureus.

You agree that Azureus, in its sole discretion, for any or no reason, and without penalty, may terminate any account (or any part thereof) you may have with Azureus or your use of the Azureus Platform and remove and discard all or any part of your account, User profile, and any Uploader Submission, at any time. Azureus may also in its sole discretion and at any time discontinue providing access to the Azureus Platform, or any part thereof, with or without notice. You agree that any termination of your access to the Azureus Platform or any account you may have or portion thereof may be effected without prior notice, and you agree that Azureus will not be liable to you or any third party for any such termination. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies Azureus may have at law or in equity. As discussed herein, Azureus does not permit copyright infringing activities on the Azureus Platform, and will terminate access to the Azureus Platform, and remove all Uploader Submissions or other content submitted by any Users who are found to be repeat infringers. Upon termination for any reason, you agree to immediately stop using and to uninstall and/or destroy all copies of the Azureus Application, any accompanying documentation, and all other associated materials.

11.2 You.

Your only remedy with respect to any dissatisfaction with (i) the Azureus Platform, (ii) any term of this Terms of Service, (iii) any policy or practice of Azureus in operating the Azureus Platform, or (iv) any content or information transmitted through the Azureus Platform, is to terminate this Terms of Service and your account. You may terminate this Terms of Service at any time by uninstalling all copies of the Azureus Application on your computer, destroying all copies of the Azureus Application in your possession, and discontinuing use of any and all parts of the Azureus Platform.

11.3 Uploader Submissions.

Subject to section 7.2 above, upon termination of this agreement by you or Azureus, Azureus will discontinue prospective hosting and distribution of your Uploader Submissions.

Section 7.2 is, obviously, even less legible legal mumbo-jumbo, but the point is, they don't really need a reason, much less specify one. Nevertheless it should be worth asking for clarification. Mainly, whether they did this by themselves or were asked to do it by some Things that Be. :ick:

BtRL is made with completely community-made stuff.  There is NO plagiarism at all.  I don't know why they are picking on you specifically, even though there are other things much more "shady" than a simply mod for BSG (a show that anyone can watch for FREE).

I understand this is scary, JR2, but in light of that one member's dad getting fined for "pirating" the Babylon 5 mod, I find this rather ridiculous.  I guess they just don't like you or something :(

I don't find it scary... I find it rather  dening... if they had a reason, you'd think they could take the time to say "for distributing plagierized material" or "for distributing pirated material"... except they probably knew I could rebuff those.  Heck, I would have been alright if they had just said "sorry, we don't want to risk being sued" - but there's no need to ban me outright for something that doesn't violate the agreement.  This brings back recent memories of SpaceBattles.com and VideoGamingForums ... at least they didn't call me a fag.  (Good thing, I might have done something nasty back.)  Of course, unless they IP-banned me, they won't keep me out for long... ;7 and even if they did, I'd just change my IP :drevil:  However, I'd rather go about this the correct way first, before I resort to the back roads.

well you can't say no plagerism, cause its based on battlestar.

thats my guess on why you were given the boot.

I could see your point if we were selling BtRL as a product.

Someone got fined for something as miniscule as that? That makes me feel terrible, with all of my... uh... not having internet access ever and not ever being able to download anything

Yes... It may be difficult to believe, but I have never been on the internet :drevil: .

With their reasoning they might as well ban anyone who ever had the word "Lost" in their stuff.  The same applies to the number "24", "Heroes", "House"... the list goes on.
Title: Re: From: Azureus <[email protected]> You are banned!! <BtRL>

No.  Look, it's not like BtrL just happens to use the name, right?  Ship designs, weaponry, the entire universe is derivative content.  And there are reasons that a copyright holder might not be too happy about having someone give away a game based on their content - especially if they think they might ever make a game themselves, it's competition.

Really, you're making a derivative work off of someone else's copyrighted works, and you don't have a license for it, right?  So, you're infringing.  Chances are nobody's really gonna care, but it's not like you can claim the moral high ground here.

Actually that makes us a derivative work. Plagiarism would be if we claimed that we came up with all the ideas for the mod ourselves. :)

Anyway looked into the matter and found this.

Broadcast on Vuze!
Vuze is a platform that enables media companies and creators of rich media content (film directors, videographers, musicians) to publish and distribute their work to millions of viewers, in high quality format (Standard-Definition and High-Definition video).

Wikipedia has this to say

Quote
Vuze (formerly code-named Zudeo) is both a BitTorrent client and content service by Azureus, Inc. The vuze.com website allows users to upload, download and share video content using this client. Unlike video sharing websites such as YouTube, Vuze focuses on DVD-quality and high-definition video content.

No where does it mention games. In fact, nowhere on the entire site can I find a single game, only trailers for them.

Which leaves me wondering, did you upload the demo to a site specifically designed for hi def video streams? Cause if you did I'm not surprised in the slightest that they kicked you off and banned you.

Creating & Loading Content

How do I choose the right "content type" for my content?
Although people may categorize each of these a bit differently, we would like to create a consistent definition for each of these categories. By having consistent definitions, we can help make our search more powerful and effective, allowing users to quickly find exactly what they are looking for. Here are the general definitions we encourage using on our site:

Video: music video, short film, feature-length movies, etc.
Audio: audio file, consisting of film scores, songs, recorded interviews, podcasts, etc.
Game: video game

You can also use specific tags and categories when publishing your content to help define it more clearly (i.e.: documentary, animation, sci-fi).

What type of files can I upload?

Movies, film, music, animation, music video, games. However, please keep in mind our Copyright Policy (http://www.vuze.com/Copyright.html) and the limitations set out in our Terms of Service (http://www.vuze.com/Terms.html).

BTW, no, I didn't take that personal; I'm just joking about the slapping.

EDIT: FYI, they did not take down my Tremulous 1.1.0 torrent, my Wolfenstein: Enemy Territory torrent, my Urban Terror 4.0 torrent, or my kkrieger-beta torrent.  Just thought that might be notable.

EDIT2:
Hmm

You got banned for uploading a computer game mod on to Vuse, BUT you uploaded others? So now you banned because in one of these Rules of conduct or legal mombo jumbo, and there is a rule that clearly defining that your not allowed to upload what??? Picture of paint smacked up against a sheet of paper? a dead ant?

Ah, as long as you only get known free stuff, or stuff that you already own, you should be alright.

I notice that all the mods that survived are in the category movie not game and have been assigned a running time.

I'm still pretty convinced that this is a movie site and they just haven't caught on to the other stuff you uploaded yet.

Hmm, well, if that's the case, they need to update their FAQ.  The reason that I didn't put anything in the category "Games", is that it is not available.  I thought it was just a bug (they changed from Azureus Zudeo to Azureus VUZE about that time) that they would eventually fix.  BtRL was set as movie too... as I said, you can only pick "Audio" and "Movie".  Hmm, besides, the BtRL soundtrack was set as "Audio", and they pulled that.  Not to mention, kkrieger was around #10 on "What's Hot" at one time.  No, I think they are aware, and that they are afraid of the BSG producers.
