I can't find it anywhere. not even on the discreet website. Yes, I've tried Google, eBay, and Amazon. If anyone knows anywhere I can get it, please post a link.

Old versions of MAX are really hard to find. Legally, that is. I'm not sure why, but I've never successfully located an old version of MAX.
I'd try a 3D artists' forum, and failing that just getting the student version of the latest iteration.

Finding MAX3 shouldn't be a problem if you know where to look, but kazza should be your last resort.

Cant help you with max 3, but not long ago, I had a copy of 3ds release 3.

Except that there is a later version still out for retail, I'd agree with that Carl. The thing is, Discreet is a bit fiddly with their products, so getting ahold of it period is pretty dubious. They took it off the market so they wouldn't lose sales on Max 5 (as that's when I'm guessing it dissapeared) since Max has not changed in its basic operation since 3 and most people don't need or want some of the "selling" gizmos of Max 5. I could of course be completely off there, but I think to assume that just because the software isn't distributed legally any more means it's copyrights aren't still actively maintained is probably pushing it a bit. That said, I'll go with Bob's answer anyway.

my school is using 3dsmax 3 and the file formats for higher versions aren't compatable.

educational purposes excuse from Dutch copyright law quite a bit. dunno about the law in the States though.
