Someone should've snuck up behind her in court and throw ice cubes down her back. That'd give her a proper panic attack and hopefully get rid of the stupid *****.

Gotta go with Vyper on this one... the idea that the girls scared her into hospital is laughable. The girls should return and do something actually unpleasent to her at some stage, she really deserves it.

I'm too lazy to write it again, so I'll quote myself from another forum.
This is why I love Canada. Something like this wouldnt fly in court here. The judge would just say "Quit wasting my time you dolt" and that would be the end of it.

I've always said that the correct response to any such stupid case is to invent an even more ridiculous counter claim and sue for the exact same amount.
For instance these two girls should have sued for their pain and suffering from the woman not eating their cookies. :D

I say they let the conviction pass, take their punishment and just say thank you.
Why? Double jeopardy. You can't be convicted of the same offence twice. Which means they would have free reign to terrorise the woman for as long as they live, without any legal consequences. And she would deserve every minute of it. Two 18 year olds spend their time baking you cakes, and you sue them!? Sorry, but thats just evil.

I mean - say you break into someones home and stab them with a knife. You're convicted (but released / let off / whatever..). You do it again. Are you saying you can't be convicted for the second crime?
Also, couldn't they be convicted of something else (harassment perhaps, or some other loophole) if anything else happened?

Double jeopardy means you can´t be tried for the same crime twice. If you are tried for killing a man and serve jail time, and that man happens to be alive, you can kill him without any problems because you were already tried.
In your example Kalfireth, those are not the same crime. They are similar crimes, but the victims are not the same.
Double jeopardy only works for situations where you are found guilty. If you are found not guilty, they can still take you to trial if new evidence is uncovered.

What if I mugged someone and stole there wallet, then I got 6 Months in jail for it, could I go and mug that person again after I'd served my time?

Who taught you guys this rubbish? Double jeopardy means you can't be tried for the same crime more than once, regardless of the outcome of the trial. Some people are trying to dismiss the rule if significant new evidence is found, but IIRC this hasn't happened in the UK yet. If you try to kill someone twice, then it's two crimes, not one, each for which you can be tried once.

Incidentally, in Scotland there is a 'not proven' verdict which allows retrial if new evidence is found.
And SadisticSid is right; double jeopardy means a single crime, not offence - the point is that you risk someone being scapegoated by being repeatedly tried for the same crime over and over again until they are convicetd by a sympathetic jury (or simply to keep them held behind bars). It also means a trial has to have sufficient evidence to be worthwhile.
Apparently, in 2003 the rules against double jeopardy were relaced by blunkett (uk).

yes, you could, but you'd get tried and put in jail again... because they're different crimes...
there's nothing sinister about double jeapardy... basically if someone is accused of murder, and found guilty, and you serve your time... you can't be accused of that same murder again: you've been found guilty of the crime already.
also, anyone remember that burglar who robbed a couple's garage while they were on vacation, and he broke his leg while he was in the garage, and couldn't get out, and so he was stuck there for like 4 days until the couple got home, and he sued them, and won ?

The judge awarded only $1 for damages, even though he could have given the plaintiff lost wages and the cost of new motion- sensor lights for her porch and more. She had itemized about $3,000 in all.
She wanted the girls to pay for her new sensor lights! Now I'm really annoyed! It's bad enough if that she had a panic attack over someone delivering cookies and wanted to be paid back for her medical bills but this $3000 bill sounds entirely too much like an attempt to fleece the girls.

You guys do know that all of the TV judges preside over small claims court, right? It isn't exactly america's last bastion of legal know-how. Besides, small claims court judges are elected, if you're going to blame somebody for this, blame the voters not the judicial system.
