Depends very very much on who you are annoying or how. After all, anonymously revealing a Politician is recieving bribes would certainly be annoying to that particular politician.

So does this law affect everyone or just USA residents? I know the company that "moderates" the internet is based in California (or around there anyway)... so does it now apply to the entire planet?

Isn't 'moderating the Internet' a bit like trying to count every insect on the planet?
I can't see how it can apply to anywhere outside the US unless each ISP's specific host country chooses to adopt the same law. I don't see that happening. Besides, as was stated in the article, the first Amendment covers the right of anonymity. In other words, it believes in the ability of people to choose the difference between fact and complete Bull. My opinions on that, however, are a whole other threads' worth of discussion ;)

I got an AT&T ad. It was quite annoying as it blocked half of the article that I was trying to read. I am annoyed. If I had a lawyer, I'd go call him.

Mr. Bush is the greatest thing to happen to this country. I thank god very day that he sent his messenger to take control of this sinful nation and restore order. We need more faith in politics. As you know the 'pest' as we now call it, was caught making the worst kind of annoying e-mail: SPAM!!! He is expected to recive the maximum sentence of 1 month in maximum security prison, and a 2 3/4 minute stay at Neverland Ranch. Most think that the extra 3/4 minute is harsh, but Bush supporters agree: Annoying e-mails is the Midddle-East terrorisim of the internet. It's too bad he dosn't have any oil to steal.

Well, there's a hook. It turns out that the statute can only be used when prohibiting the speech would not violate the First Amendment. If speech is protected by the First Amendment, the statute is unconstitutional as applied and the indictment must be dismissed. An example of this is United States v. Popa, 187 F.3d 672 (D.C. Cir. 1999). In Popa, the defendant called the U.S. Attorney for D.C on the telephone several times, and each time would hurl insults at the U.S. Attorney without identifying himself. He was charged under 47 U.S.C. 223(a)(1)(C), and raised a First Amendment defense. Writing for a unanimous panel, Judge Ginsburg reversed the conviction: punishing the speech violated the Supreme Court's First Amendment test in United States v. O'Brien, 391 U.S. 367 (1968), he reasoned, such that the statute was unconstitutional as applied to those facts.
