Title: Guess this makes most of HLP criminals...
Post by: Goober5000 on January 09, 2006, 03:34:05 pm
It's now illegal to annoy someone over the internet without using your real name (http://news.com.com/Create+an+e-annoyance%2C+go+to+jail/2010-1028_3-6022491.html?part=rss&tag=6022491&subj=news)

Depends very very much on who you are annoying or how. After all, anonymously revealing a Politician is recieving bribes would certainly be annoying to that particular politician.

Sorry BlackDove, we're going to have to ban you for the good of everyone here.

Yeah. Right.

So does this law affect everyone or just USA residents? I know the company that "moderates" the internet is based in California (or around there anyway)... so does it now apply to the entire planet?

I guess I should probably stop spamming the White House with this:

Isn't 'moderating the Internet' a bit like trying to count every insect on the planet?

I can't see how it can apply to anywhere outside the US unless each ISP's specific host country chooses to adopt the same law. I don't see that happening. Besides, as was stated in the article, the first Amendment covers the right of anonymity. In other words, it believes in the ability of people to choose the difference between fact and complete Bull. My opinions on that, however, are a whole other threads' worth of discussion ;)

*Is annoyed at having to read 1337*

*Informs the government of CP5670 as if it were his real name*

*Realizes it isn't his real name*

*Doesn't actually know his real name*

*Realizes that CP5670 probably wouldn't come forward with his real name had he actually broken the "Can't 'annoy' online law"*

*Realizes how worthless this new law really is*

*Wonders if typing in third person and with asterisks is annoying anyone yet*

*Keeps using them anyway*

*Gets up and grabs a snack from the fridge*

*Asks for a cool title and some avatars, even when not involved in any projects other than taking cool screenshots*

*Realizes 'taking cool screenshots' is quite possibly as far from being involved in a project as can be*

*Wuvs HLP*

*Is done now*

*Really*

I got an AT&T ad. It was quite annoying as it blocked half of the article that I was trying to read. I am annoyed. If I had a lawyer, I'd go call him.

Here. I'll annoy everyone in this thread easily.

Mr. Bush is the greatest thing to happen to this country. I thank god very day that he sent his messenger to take control of this sinful nation and restore order. We need more faith in politics. That's what this couuntry, nay, the world is lacking. In fact, the US shoul educate the Europeans about Jesus and the bible as well. Europe, Asia, the middle east? The middle east, ha! Glass the ****ers! Lets take their oil!

Did that work?

We don't know where  this 'first grade bandit' is hiding. For all we know, they could be hiding in that coffee shop attempting to send another e-mail...       ...TO YOU!!!

*later that week*

As you know the 'pest' as we now call it, was caught making the worst kind of annoying e-mail: SPAM!!! He is expected to recive the maximum sentence of 1 month in maximum security prison, and a 2 3/4 minute stay at Neverland Ranch. Most think that the extra 3/4 minute is harsh, but Bush supporters agree: Annoying e-mails is the Midddle-East terrorisim of the internet. It's too bad he dosn't have any oil to steal.

I News.com misinterpreted it:
http://www.boingboing.net/2006/01/09/flame_someone_anonym.html

Anyway...
Rudolph, the red-nosed reindeer
had a very shiny nose.
And if you ever saw him,
you would even say it glows.

All of the other reindeer
used to laugh and call him names.
They never let poor Rudolph
join in any reindeer games.

Then one foggy Christmas Eve
Santa came to say:
"Rudolph with your nose so bright,
won't you guide my sleigh tonight?"

Then all the reindeer loved him
as they shouted out with glee,
Rudolph the red-nosed reindeer,
you'll go down in history!

If the song doesn't annoy you, the fact that I tried annoying people deliberately MUST work! :(

I'm guessing its only intended for extreme stalking cases.
But a law in the US means squat to me. So the US government can blow me. ^_^

Stupidly obsessed about the ability to sue people for stupid things. I'm surprised no one has attempted to sue Bush over something or another. Invasion of Privacy?
I bet theres something there.

I wonder if it's a law people can take advantage of?
BTW, what's the other stupid thing called "emotional damage"?
I know people can deal with being annoyed, being annoyed, and having their minds eye burned all to hell because they saw their mother naked.
Seems like this is something politicians are reacting against people with because they can't deal with what's written in blogs about them?
I hope things don't turn more 1984esque (oddly enough the year i was born).
Bush should be considered annoying.
But he should most definitely have tourette's, that'd just be plain funny. :p

Well, there's a hook. It turns out that the statute can only be used when prohibiting the speech would not violate the First Amendment. If speech is protected by the First Amendment, the statute is unconstitutional as applied and the indictment must be dismissed. An example of this is United States v. Popa, 187 F.3d 672 (D.C. Cir. 1999). In Popa, the defendant called the U.S. Attorney for D.C on the telephone several times, and each time would hurl insults at the U.S. Attorney without identifying himself. He was charged under 47 U.S.C. 223(a)(1)(C), and raised a First Amendment defense. Writing for a unanimous panel, Judge Ginsburg reversed the conviction: punishing the speech violated the Supreme Court's First Amendment test in United States v. O'Brien, 391 U.S. 367 (1968), he reasoned, such that the statute was unconstitutional as applied to those facts.

Pah.  Being unconstitutional seldom stops the Supreme Court.  Look at Kelo v. New London, for instance.
