SC to probe TRO fixers, justices in appeals court

THE Supreme Court has ordered an investigation into the alleged indiscriminate issuances of temporary restraining orders by 12 Court of Appeals justices, dubbed the “dirty dozen.”
In a one-page resolution of the SC en banc, the Court ordered the Office of the Court Administrator (OCA) to appoint a judicial supervisor that would audit the cases heard by CA Justice Romeo Barza, who is suspected of being among the “dirty dozen.”
The Court issued the ruling based on a 23-page verified disbarment complaint/letter affidavit of former Malabon RTC judge Florentino Floro Jr. before the SC for charges of gross misconduct, gross ignorance of the law, manifest undue interest, questionable temporary restraining orders, grave violations of Republic Act 6713, or Code of Conduct and Ethical Standards, against the members of the “dirty dozen” and CA Justice Romeo Barza.
Barza was a former PJA president and a former senior partner of the Carpio Villaraza Cruz Angangaco law.
The SC also ordered the “designated judicial supervisor to submit a report to the Office of the Court Administrator within 30 days from date of investigation.”
Floro also asked the Court to conduct a judicial audit and preventive suspension against the “dirty dozen.”
The “dirty dozen” of the appellate court is composed of 10 male justices and two lady justices, who are on the list of alleged corrupt magistrates in the CA, according to Ombudsman Merceditas Gutierrez.
The CA is composed of 69 justices, 51 of which are stationed in Manila . Majority of these justices came from the lower court.
Flora based his case against Barza on the justice’s “frequent” issuances of TROs as reported by lawyer Mercedita G. Dadole-Ignacio, CA Cebu Division Clerk of Court to CA Clerk of Court lawyer Elisa Pilar-Longalong, according to the complaint.
Barza issued five TROs from January 18 to February 26, 2007, or a series of five TROs for five consecutive weeks, the complaint said.
Based on records submitted by the 23 Divisions Clerks of Court of the appellate court, the most number of TROs issued was by Barza, during his stay at Cebu CA. Barza is now with the CA in Manila .
The TROs were issued in connection with the cases of Sun Life of Canada v. National Labor Relations Commission, Armed Forces of the Phils. v. Yolanda Lauron, Doloreich A. Dumaluan v. Ombudsman Merceditas Gutierrez, Assumption Iloilo v. Fedy T. Bhuiyan and O.G. Holdings Corp. v. Environmental Management Bureau.
Floro also prayed that upon due notice and hearing, “judgment be rendered dismissing respondents from service, with prejudice and recommending the filing of criminal charges against them for violations of R.A. 6713 and R.A. 3019 [antigraft and corrupt practices act], and under R.A. 1379, or Forfeiture of Illegally Gotten Wealth.”
He cited pertinent laws that were violated such as the violation of the Code of Judicial Conduct, Code of Professional Responsibility and the Revised Administrative Code of 1987.
Recently, the Supreme Court set an example by sacking CA Associate Justice Elvi John Asuncion due to delays in resolving the motions for reconsideration within the required period and the irregular issuance of a TRO.

Fire hits Court of Appeals building
A blaze has engulfed the main building of the Court of Appeals (CA) in Quezon City , DZMM reported Thursday.
The initial report said the fire started in the room of CA Justice Edgardo Sundiam on the structure’s fourth floor. It said that the staff of Sundiam immediately evacuated the room when the fire was already spreading.
DZMM reporter Nelson Lubao described the blaze as ‘very strong’. He said that the fire has spread to adjacent buildings.
A hearing on the case of missing farm technologist was scheduled by the CA Friday, 10 am after the Supreme Court issued an order for the Armed Forces of the Philippines to present Burgos before the. It is not yet known if the hearing will continue.
As of posting time, there were no reported injuries.

I am still JOBLESS judge in this pretend world, and my sufferings are very very little compared to the many EXTRA-judicial killings here in the Philippines, since July 17, 2007, now at more than 60 dead, filipinos killing filipinos...
You are more blessed than all of us, but as GIFTED,
I had been an instrument for all these cleansings ...

That can be incorporated into a bot. As I said, it's well designed. Although a typo wouldn't really happen in the middle of the title if a real human was pasting it.

Yup, I thought about the possibility of the fact it was incorporated, but then, it could also be that the article was pasted, but the title was hand-typed. Still, I guess all you need is a routine that omits a letter at random intervals out of non-code text to make it look more 'human'.

The replies don't make any sense half the time and are irrelevant to what was quoted.
My guess is that he looks for certain common words or phrases in the posts and is designed to deal with many standard types of remarks that others would post, but it only sometimes works.

Let me clarify, that It was a PinoyExchange forum member that wrote about me in WIKIPEDIA, since the rules forbid me to write about myself;
I committed a mistake of editing it so they almost banned me
but because of my more than 500 links, and nice story,
the admin FISHERQUEEN re-wrote it;
now, they re-edited it and not it is just that short;
Wiki is very neutral and there are members who mercilessly EDIT it
I contributed a lot to wiki
since there, it is a race against time

since my case caught global attention,
then I had to reply to more than 100 forums
IMAGINE if my own human nature will respond to each and everyone of the posts, debating on whether the real judge floro is bot or not
it would be impossible

The Philippine National Police (PNP) is under orders to address the series of killings of village captains in the country as the barangay and Sangguniang Kabataan elections in October approaches.
Executive Secretary Eduardo Ermita said Tuesday at Camp Crame that the PNP, and even the military on the ground, is expected to do its job in addressing the killings, noting that any problem on peace and order "is a cause for concern" by the Arroyo government.
"Of course, the President has ordered that it (killings) should stop. It should not even happen," Ermita said in Filipino.
As of Tuesday, five village chieftains have been reportedly killed since President Gloria Macapagal Arroyo delivered her State of the Nation Address (SONA) last July 23 where she ordered Congress to craft laws that will impose harsher penalties on political killings.
Two of the reported slain barangay captains are from Metro Manila, while three are from the Southern Tagalog area.
"I am asking all our barangay captains, officials and other candidates (for the upcoming local elections) to cool their heads this coming elections. Let us leave it to the people to decide who they want to vote this election, who they want to give a mandate over the barangay," PNP chief Director General Oscar Calderon said in a separate interview.
"Let us have a peaceful election," he said.
Calderon said the PNP is now preparing for the upcoming elections and is in fact identifying already the villages where electoral violence is imminent, based on its history. - GMANews.TV

At least two persons, one a child, were injured and 12 families rendered homeless after a tornado hit three villages in Candaba town in Pampanga province Monday afternoon.
Sun-Star Pampanga (www.sunstar.com.ph) reported Wednesday that the victims were initially identified only as Erwin, 12, and one Beng Chu, a stay-in worker of a duck farm.
The tornado destroyed two houses and damaged 10 others in the villages of Tinejero, Talang and Dalayab.
Maricris Santos, a resident of Barangay Tinejero, said she and her family were inside their home when the tornado hit their area. She said their roof was blown away.
Their roof was later found in a nearby rice field, she said.
Tinejero village chairman Alfredo Lajong said it was the first time that a tornado hit their area.

At least one person was hurt while several areas lost electric power after tornadoes hit two villages in two neighboring towns in Nueva Ecija province Tuesday evening.
Radio dzRH reported Wednesday that the tornado hit San Miguel village in Quezon town and Mambarao village in Santo Domingo town in Nueva Ecija at about 6 p.m. Tuesday.
The tornadoes followed heavy rains and winds and damaged several houses. Sketchy initial reports indicated one Jon-jon Bitardo was injured after parts of a house fell on him.
Several areas were also reported to have experienced power outages after electric posts in areas where the tornado passed collapsed.
Local officials are now assessing the damage caused by the tornadoes.
Santo Domingo is a fourth-class town with a population of 45,934 people in 9,532 households. Quezon is a fourth-class town with a population of 31,720 people in 6,389 households. - GMANews.TV

A mutilated head of a woman was recovered inside a lunch box found floating in the Pasig River in Mandaluyong City on Monday.
Bigonio Balatera, a Bantay Bayan member, saw a blue lunch box floating in the river along Mabini J. Rizal Plaza at around 3 p.m.
Out of curiosity, Balatera opened the lunch box and was surprised to discover a woman’s head.
He immediately reported the mutilated head to his fellow barangay officials, who in turn called up the local police.
Thinking that the recovered head could belong to the same woman whose mutilated torso was found in San Juan City last Sunday, Mandaluyong City police chief Senior Superintendent Ericson Velasquez coordinated with San Juan police chief Superintendent Rodelio Jocson. They decided to bring the two body parts to a single funeral parlor for easy disposition.
Scene of the Crime Operatives (SOCO) of the Eastern Police District (EPD) are now cross-matching the severed head with the mutilated torso.
“The recovered head and torso are still in a funeral parlor in Mandaluyong City. There’s no claimant yet,” said Jocson.
Velasquez said someone went to his office Tuesday to report a missing relative and he directed him to visit the funeral parlor. The mutilated woman was not his relative, the man later said.
There were no identification marks except for a mole on the woman’s buttocks.

13-year-old gangraped in Manila
A 13-year-old girl was raped by seven men, four of whom have been arrested in Manila Tuesday, DZMM reported Wednesday.
Police said one of the suspects invited the girl to his house on Blumentritt Street where she was raped alternately by three men. The suspects then brought her to another house where four men took turns in sexually abusing her.
Police said village officials raided the second house after getting a tip. Four of the seven suspects were arrested during the operation. Two of the suspects are 17-year-olds.
Police said they are now hunting down the three other suspects.
The report said police are expected to present the arrested suspects to Manila Mayor Alfredo Lim Wednesday.

Two bombs ripped through a crowded bus terminal in the southern Philippines on Friday, killing at least one passenger and wounding four others, police said.
An improvised bomb left near the baggage of passengers waiting to board buses was the first to explode, followed shortly by a blast inside an already empty bus.

(Updated 8:08 p.m.) Justice Secretary Raul Gonzalez was rushed Friday to a still undisclosed private hospital in Metro Manila due to severe ulcer attack that usually eats into the blood vessels and the blood seeping into the digestive tract.
In a phone interview, Gonzalez declined to reveal the name of the hospital where he was confined but said he has been on medical leave since Wednesday.
"Dito lang ako sa tabi-tabi (I’m somewhere in Metro Manila)," the ailing secretary said in jest. Gonzalez, 76, has taken up residence in Valle Verde in Pasig City.
In a separate phone interview with GMA-7 reporter Joseph Morong, Gonzalez said he was brought to the hospital "umagang-umaga" (very early Friday morning).
Gonzalez also denied that he was brought to the intensive care unit of the hospital, but he expects to be discharged Saturday or before the end of the week.
"I got a bleeding ulcer. I feel heavy but I'm alright. I'm in bed," he said in a slightly groggy voice when asked how he was feeling. He said that his physicians did not recommend that he undergo any surgery to remove the ulcers.
What is bleeding ulcer?
Bleeding from ulcers or gastrointestinal hemorrhage occur in the stomach and duodenum, according to online medical dictionary. If the bleeding is heavy, people will feel tired and weak.
The disease is treated with several types of medicines including H2-blockers, acid pump inhibitors and mucosal protective agents. Patients could go under the knife if they fail to respond to medication or if they develop complications.
Kidney problem
Asked if he thinks he would be ready to return to work by Monday, he said: "[Maybe], we'll see."
This is not the first time that Gonzalez has been taken to the hospital. After his trip to the hospital last April, he has started holding office at the Annex building of the DOJ instead of at the second floor.
Reporters are aware that Gonzalez has a kidney problem but he has consistently kept mum about details. "Basta kidney problem daw."
Recently, Morong said Gonzalez fell ill, "masama ang pakiramdam, nagsusuka. He said he didn't know he had ulcers."
Before assuming the post of Justice secretary in 2002, Gonzalez had reportedly undergone dialysis treatment.
The last time he was hospitalized, Gonzalez was taken to the Dr. Victor R. Potenciano Medical Center (formerly Polymedic Hospital) on EDSA in Mandaluyong City, where his wife is a stockholder. The hospital is a short distance away from the Gonzalezes' home in Valle Verde.
Morong said that from the tone of his voice on Friday, Gonzalez seemed to be just mildly ill. "The sarcasm is still there." In prior illness episodes, Gonzalez had been observed to have turned serious and humorless.
Radio dzBB station said it also got in touch with Gonzalez himself through a cell phone interview, although the secretary withheld details of his medical condition.

MANILA, Philippines -- (UPDATE) Saying “the well-documented violence that continues with impunity must be ended,” 49 members of the US House of Representatives have written President Gloria Macapagal-Arroyo urging “strong and immediate leadership” to end extrajudicial killings and other human rights abuses.
“Since the extrajudicial killings in the Philippines continue unabated, and given the fact that there are many unanswered questions about the role of the Philippine government and military in these deaths, we respectfully request your strong and immediate leadership in investigating and prosecuting those individuals and/or groups, including those in the AFP [Armed Forces of the Philippines] and PNP [Philippine National Police], responsible for these killings, and in eliminating the underlying causes of the violence,” the bipartisan letter, dated August 1, said.
The solons also worried that US aid to the Philippine military and police is being used to commit the killings, which human rights groups estimate have claimed the lives of more than 800 people -- mostly left-wing activists -- since Arroyo came to power in 2001, and other human rights violations as part of the government’s counterinsurgency program.
“We are very concerned that the extrajudicial killings could be a conscious and systematic part of the Philippine government’s counterinsurgency program and that financial assistance from our government is being used to support, directly or indirectly, those within the PNP and AFP who are responsible for the killings,” they said.
Noting that “the AFP and PNP receive a significant amount of aid from the United States to assist in training and professionalizing the Philippine security forces, to combat terrorist groups, and to upgrade military equipment and hardware,” they said “the numerous reports that our and other congressional offices receive indicate the need for our close monitoring of this situation, particularly regarding the alleged use of US assistance to implement the abductions and killings.”
The letter was initiated by Representatives James L. Oberstar (Democrat-Minnesota) and Joseph R. Pitts (Republican-Pennsylvania) and its signatories included the following chairman of House committees and bodies: Tom Lantos (Democrat-California), Committee on Foreign Affairs; David Obey (Democrat-Wisconsin), Ways and Means Committee; John Lewis (Democrat-Georgia), Oversight Subcommittee; and Mike Honda (Democrat-California), Asian-Pacific American Caucus.
The letter is just the latest in a series of actions by the US Congress to pressure the Philippine government to stop the extrajudicial killings.
Last March, the US Congress held a number of hearings on the issue and invited Filipino activists and church leaders to testify. After that, it included in the Foreign Operations Bill a provision specifying that US military aid to the Philippines cannot be used against Filipino civilians.
“As you may know, there is increasing evidence from well-regarded human rights organizations, including the Melo Commission created by your government, which indicates the involvement of personnel from the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP)” in the killings, the solons’ letter told Arroyo.
Amnesty International and the United Nations Special Rapporteur Philip Alston have reported similar findings.
According to Philippine-based human rights group Karapatan (Alliance for the Advancement of People’s Rights), since Arroyo became president in 2001 until May 15 this year, there have been 863 extrajudicial executions (including 51 journalists) and 196 abductions.
The Philippines is the largest recipient of US military aid in Asia. This year, the US State Department proposed a total of $11 billion of military aid to the Philippines; this amount has been raised to $30 billion by the US Congress. The bill containing this proposal has not yet been enacted into law.
Described by Oberstar as “a sincere communication between the two governments” intended to elicit a positive response from the Philippine government, the US legislators’ letter aired deep concerns over a “growing environment of impunity” in the Philippines.
“The killing of civilians who are peacefully exercising their lawful right in a democratic society to express dissent is a gross violation of universally recognized human rights and international law,” it said.
The lawmakers also cited the May 27 abduction of Pastor Berlin Guerrero, who was allegedly beaten by the abductors until he gave them the names of his family, parishioners, friends, and the password to his computer. The abductors reportedly then replaced Guerrero’s computer documents with incriminating documentation connecting Guerrero to the underground left.
Guerrero remains detained by the Cavite provincial police.
Reports received by US congressional offices say Guerrero had been tortured while reports from the United Church of Christ in the Philippines said the PNP has pointed to Philippine Navy intelligence units as the ones responsible for the pastor’s abduction.
In reaction, the US-based Ecumenical Advocacy Network on the Philippines said the Congressional letter represents a growing awareness of US policymakers about the six-year surge of violence against progressive leaders in Philippine civil society.
“But more needs to be done to ensure that US dollars are not supporting security forces in violation of US law,” it said.
The Ecumenical Advocacy Network represents a coalition of American and Filipino-American church leaders and human rights advocates throughout the United States, lobbying against human rights violations in the Philippines.

MANILA, Philippines -- Three days of fighting between government forces and Al Qaeda-linked Abu Sayyaf militants and their allies in the southern island province of Sulu has left 57 combatants killed and 42 others wounded, a military spokesman said Friday.
A nine-year-old boy, reportedly a son of an Abu Sayyaf commander, was also killed during one of four engagements.
He was caught in the crossfire when Abu Sayyaf members, assisted by rogue Moro National Liberation Front (MNLF) rebels, ambushed Army troopers in Maimbung town on Thursday morning, said Lieutenant Colonel Bartolome Bacarro.

The dwarves, isn't that clear? :) It makes all the difference in the world. It's the same principle that, for example, makes banal and coincidental things "answers to prayers" for so many people every day.
To be honest I'm a total agnostic and can't know if there are or aren't any divine beings doing stuff in the universe, but as long as I don't have convincing evidence for them I'll keep assuming that they don't exist or if they do, choose not to affect our little world in any notable way.
In the meanwhile I can't deny the reality of these beings to people who do believe in them, and believe that they affect the world as much as they affect the actions of the people that believe in them... God, for example, has caused a lot of things to happen in the world regardless of his/her rather questionable physical existence, so in a way you could say it's "real" all right. But I digress. To the point then, shall we...
I daresay a lot of Filipino judges would have interesting time when asked a few questions like "Do you believe in a supreme being, or 'God' if you will?", "Do you pray?" and "Are your prayers answered?"
Yes to first question would mean that they believe in invisible creature(s) like our friend Judge Floro.
Yes to second question would mean that they talk to the invisible creature(s) like our Judge Floro.
Yes to third question would mean that, either they are talked back to, or otherwise convinced that the invisible creature(s) responded to them, like they apparently do to our Judge Floro.
Having Judge Floro put on... extended leave only based on the facts that he believes in invisible creatures, talks to them and believes they respond is, IMHO, hypocritical at best and downright ridiculous when it's observed that a whole lot of people do exactly the same and still act as profitable members of community. Should it be concluded that believing in invisible creature(s) is all right as long as enough people believe the same?
Or should it be concluded that religious people actually, in the deepest corner of their mind, have a deep doubt that their beliefs actually might be just as real and convincing as the Three Divine Dwarves? :drevil:

Personally, I respect the beliefs of atheists, agnostics and skeptics/pure scientists; WHAT I DO HATE most, is HYPOCRISY practiced by Catholic Philippine Justices who (like Justice Nazario and Austria Martinez) who hear mass and pray rosary daily, but are involved in corruption practices, as HONORABLE THIEVES, and abuse the Rule of Law by writing decision based on the Rule of Vengeance.
Wisdom cannot be gained by closing one's thoughts and beliefs, and debunking others' perceptions of the things on this wild planet.
What's the difference between consulting ANGELS, ALLAH, BUDDHA, MARY, JESUS, SATAN, quoting the Bible, Korran and Buddhist teachings, in decisions,
