Depends. If the weapon had a hair trigger it might be possible.

Carrying a loaded shotgun and aiming it at people? Who cares if he claims it was an accident!
And I'm not just being touchy. I like gunz. But you do not handle a loaded weapon that carelessly.

Murder requires intent to kill. Which makes the claim it was an accident very important.
Although what surprises me is why they didn't charge him with murder and give the jury the option of returning a manslaughter verdict if they found him guilty.

Depends on the definition of murder. Some states have laws on the books for "depraved indifference" on a second-degree charge.
