Because "certain Arizona authorities" = "the entire US."  This is a horrifically asinine case, but please, spare us the hyperbole.

Also, While every piece of child pornography contains nude children, not every pic of a nude child is child porn. Seriously, that topic is the cause of waaaay too much hysteria.

Too bad it took the judge so long to slap some sense into the authorities.

Seriously, I sincerely hope those parents win the lawsuits against the state.  Just because a law *might* apply to a situation doesn't mean it should always be applied.  The lack of common sense in some police departments is absolutely astounding.

I don't doubt that the Walmart lawyer will attempt to argue that punishing Walmart for doing this may endanger children at a later date, since employees will be afraid to follow up on concerns.

To my mind, the people at fault were the Police, Walmart are free to raise concerns about photos, but the Police reaction of 'Guilty until proven Innocent' was wholly wrong, a simple phsychological evaluation in a few hours would have provided enough evidence to warrant leaving the children with their parents whilst the investigation took place, but instead they assumed the children were being abused and took them away from their family, therefore creating their own damage to both the children and the parents. It was a stupid, paranoid reaction from the Police that when wholly against the basic tenets of law, as well as causing irrepairable harm to a family.

Personally, I'd be looking to sue the child protection and law enforcement side of the argument rather than the group that raised the concern, since they had a far better picture of the family environment these kids lived in than Walmart does.

I'm sure there could be "child porn" that doesn't even have nude children in it. So it's incredibly stupid.

Now to actually watch the video...

Edit: and they got listed on a sex offenders registry because of this! Too bad I don't believe in hell, or I'd want the dumbasses responsible for that to burn there... Those lists probably ruin more people's lives than were affected by the people on them.

Well given that taking nude pictures of toddlers is only done so that you can embarrass them with them 20 years later these guys got what they deserved. :p


But seriously this isn't Walmart's fault. Any idiot knows that if you take pictures of something that appears to be a criminal act they can be handed over to the police. I do agree that the police completely overreacted though.
