HTL Sath, check the arms.
-
is that a.... CASE? o.0
-
But why "xtreme gaming"? FSO can actually run on a potato.
-
Right up until you turn shadows on :P
-
Isn't that the Sath model form the current Media VPs, (says Captain Obvious)? Did someone at that convention ask permission from the Team (or Volition) before using it?
-
I'm no expert but it seems to me that would fall pretty solidly within fair use.
-
That's completely, totally wrong.
-
Dats pretty cool

Maybe then you can either explain or refrain from being a smug ass about it?
-
That reminds me, there's an (Xfinity?) ad on Twitch that has what looks suspiciously like a Kentauroi. I'll have to pay more attention next time it comes up.

Or you could try reading something about fair use (https://en.wikipedia.org/wiki/Fair_use) before saying something would "fall pretty solidly within" it. For starters, this would obviously seem to be a commercial usage (unless you're suggesting Gigabyte slapped their brand all over this for non-profit educational reasons?). Your best argument would be that it doesn't commercially harm either Volition or Rga_Noris(? I think that's who modeled that version, but somebody correct me if I'm misremembering that), but if that's your only argument, you're on very weak footing for arguing Fair Use.

... Unless it turns out that the modeler actually works for Gigabyte now :p

Except it's still based on Volition's IP, so they'd also need to give permission.
Which would still, by the way, not be "Fair Use" (which specifically is for using it without getting permission).
-
Slapping your brand all over someone else's work so you can use it for advertising is not limited use in a transformative work for the purposes of commentary, criticism or parody, which is what fair use is actually for.
-
On the other hand, didn't Rga_Noris has release his model without any licensing information (I can't find any in his thread, at least)? If someone just found the model on Google or somesuch, how was he supposed to know that it's based on some obscure, ancient video game? While the Sathanas itself is :v: IP, this particular model was made by Rga_Noris and I don't think :v: has any rights to it (that said, the model in itself is in a legal gray area, too).
It probably still isn't exactly legal, but IMO, it should be. They're not even using Sathanas itself (as in, any of the story behind the design), just the shape, which to most people is just a cool shape. I see no intention to hijack :v: property for advertising.
-
It would be hard to make any serious case on this. I don't think any license (if we have one at all) would be binding since the models are based on commercial IP. A bigger question is, what was the point of this? I doubt anyone there would know about Freespace well enough to recognize the Sathanas, and if you don't know what it is it just looks some weird sculpture, especially in that color scheme.
-
I think that's the point here.
-
I have a feeling there was some sort of contest and these were the winners, that's just what this looks like to me, but I have no evidence of that, so let this be the post that drives you to do more than mere speculation.
-

What do you mean?
-
He means a computer case. And, so far as I can tell, yes, it is.
-
I suppose this is how the Shivans infiltrate and destroy 'god' tier civilizations: let themselves be shown off, popularized, then before you know it the sun's gone supernova.
