but i wonder...we are not indending on making profit or any money at all for that matter.  
Im not sure you can hold rights to an Idea as such, as far as i can remember all the rights are held by the company that made it, ie all art work / code is owned by the company that made it, not the artist, and since the code was released they have no rights as such except we cant sell it on for profit.  

Art on the other hand wasnt released and as such probably shouldnt be used now with out there consent, so your probably right about the art.
