US federal court has halted a trial at Guantanamo Bay of a former driver for al-Qaeda leader, Osama Bin Laden.

The judge said it must first be determined whether Salim Ahmed Hamdan, from Yemen, was covered by the Geneva conventions.

What the ****? Somethings not kosher about this. Why do they all of a sudden start caring about the Geneva convention, and then only for 1 person, and a driver of all things..

makes no sense.

Alternatively it could be because they need to cover their backs for any atrocities that may happen during this latest offensive in Iraq (i.e. they respect Geneva convention on POWs so everyone else should)

Quite simply, because this is from the judicial branch, instead of the legislative or executive branches.  And it wouldn't be all of a sudden, as it would most likely have been in the works since July, when the U.S. Supreme Court ruled that the detainees could legally appeal their imprisonment.  My question is whether this was from a district court or appeals court, as that affects what happened already and what happens next. If this was a district court, it would then be moved up to a federal appeals court, as district courts lack appelate jurisdiction.  But if this was an appeals court, it would have already gone through the district court system and would most likely be on the way to the Supreme Court.

Presumably some nasty evil traitor lawyer type managed to slip in the issue of fair justice & constituational legality into Gitmo.  Silly boy - doesn't he know these people are Ara....terrori....illegal comb.....Arabs?
