I daily receive E-mails which say I won 5,000,000,000 dollars on the lottery and try to make me click on various links. Is that better spam?

I already announced my retirement twice, yet here I am. If I bring up that topic again, don't believe a word.

Surely given the statement that spam must be deceptive to be classed as spam I could send 100,000 'This email is about viagra' messages in that state completely legally?
