Actually I don't believe there are any laws in the United States against owning a nuclear weapon since the case has never come to court  

Generally when people try to make nukes environmental protection agencies and the nuclear commission arrive to dismantle the device to avoid contamination. (there was a kid who made a small reactor out of the radioactive elements in smoke alarms and this occured)

Alright, I'll admit to not doing my homework on it  

I do know that in the cases such as with the small reactor, not much of a fuss was made since no one was contaminated and no one got prosecuted.

However with an actual weapon of mass destruction, I do not know the actual legaliese dealing with them. (illegal makes the most sense, but there could be "special" clauses now thanks to our "special" president in the US   )
