well, you can just root it and get it from an alternative market... oh, right, that's android.
You don't need to root android to install 3rd party (non-google-market) apps. My Inspire had the option to install 3rd party apps in USB debugger options on the stock ROM back when too. Some apps do need root though, even in the market.
You can jailbreak the iPhone... but it voids your warranty.
Ah so does rooting. The trick is if you brick it you either drop it in water, or let something heavy (hammer) land on it, enough to break the screen. The only difference at that point is you can save your data by taking out the SD card on an android.
Sucks that you missed it though, Google took 99% of the emulators off the market right as I was wiping my Inspire, still having trouble finding a couple of them.
