[color=cc9900]As far as I'm concerned, this case has nothing to do with Linux. It is about a money-grabbing semi-company trying to get a quick buck by asserting itself against a reputed company.

You would be well advised to believe things that Linux advocates put forwards when those same advocates use evidence from open source to back them up. Anybody is to be pitied if they blindly follow what others say, but here we have a case where the two parties have different qualities of evidence.

May I enquire, what parts of this case as asserted by SCO do you find genuine?[/color]

Well, since i have the same capabilities as the linux advocates to see their source AND to see MS one as MVP i can truly say that 80% of the voices around MS are only prejudices and empty air.
About the genuine parts, the optimization routines are clearly SCO stuff, IBM surely has not copied as much as SCO tells, but there are some very specific parts of the code that are exactly the same...

I think Zarax has forgotten the history of the computer industry in his blind hatred of IBM and his blind love of Microsoft. He's also ignoring lots of stuff that some of us have pointed out to him time and again about his personal corporate heroes, but I digress.

At issue here is IBM's supposed copying of source code from the AT&T UNIX source code into Linux and other open source projects. The things that Zarax (and SCO) are ignoring (or trying to cover up) include:

• Some of the code that was "copied" existed in IBM operating systems BEFORE they existed in any SCO operating system
• SCO is suing for infringement to code that they bought AFTER the supposed infringement took place.
• Much of the code that SCO is asserting as theirs was actually BSD  code, which is licensed so liberally that anyone can legally take it and use it in a commercial project without compensating anyone beyond a copyright line
• IBM has the actual PATENTS on some of the software processes taht SCO is claiming they have copyrighted code for. The patents will trump SCOs supposed copyrights every day of the week

The SCO/IBM thing is entertaining, to say the least. In the 80s, IBM got its ass handed to it over copyright and patent (these are seperate) issues regarding the creation of the clone PC market. Ever since, IBM has been very, very careful to document and manage their source code and patent portfolios very carefully (did you know that IBM has the single biggest patent portfolio on earth, and its the fastest growing: they are awarded more patents every year than ANY other patent holder in the world). IBM has had twenty years of learning from its mistakes. Given that they have more money, more lawyers and more governmentally mandated monopoly power than SCO could ever hope to scrape up, SCO is going to gets its ass surgically removed, spitted, roasted and served up on a platter with a nice garnish.

The whole SCO thing is barely a scratch to IBM.

IBM is one of those companies that doesn't even need to flaunt its assets. It's got enough power and money to shrug off anything.

If there were a thermonuclear war, all that would be left would be IBM, the cockroaches and the computers IBM was selling to the cockroaches.

Me, I'm just waiting for IBM to release their attack lawyers--the ones they feed only raw meat and only once every couple of days--on SCO. I'm looking forward to SCO becoming the next wholly owned subsidiary of IBM. Not because I have any great love of IBM, but because stupid people who do stupid things should be punished. Sticking a giant with a toothpick to show you have a big dick is stupid and that's exactly what SCO did.

It should be pointed out that we're all referring to SCO like its SCO that did this. Its not. ITs the SCO Group that did this. SCO is dead and has been for a while and they were decent people.
